  1. SPONSOR: Sweepstakes is sponsored by Latham Pool Products, Inc. ("Sponsor"), 787 Watervliet-Shaker Road, Latham, NY 12110.
  2. ADMINISTRATOR: Ventura Associates, Inc., 1040 Sixth Avenue, New York, NY 10018, an independent judging organization whose decisions are final and binding with respect to the sweepstakes (“Administrator”).
  3. ELIGIBILITY: The Pool Makeover Sweepstakes (“Sweepstakes”) Sweepstakes is open to legal residents of the 48 contiguous United States (except Colorado)and the District of Columbia age 21 or older at time of entry and to whom this offer is addressed and who own a home with a pool installed at time of entry. Employees and their immediate families of Sponsor, and its affiliates, subsidiaries, advertising and promotion agencies not eligible to enter. All federal, state and local laws and regulations apply. Void in Alaska, Colorado, Hawaii and where prohibited by law and outside the United States.
  4. ENTRY PERIOD/How To Enter: To enter, visit http://www.pacificpools.com , OR http://elite.surfthepool.com , OR http://sterling.surfthepool.com , OR http://www.kafko.com , OR http://www.lathamint.com between 12:01 AM, Eastern Time (ET) on 3/1/11 and 11:59 PM (ET) on 4/30/11 (“Entry Period”) and follow all entry instructions to complete and submit the online entry. Online entrants subject to all notices posted online including but not limited to Sponsor’s privacy policy which can be viewed at http://www.lathamint.com/index.php/privacy-policy.html, OR http://www.pacificpools.com/legal , OR http://elite.surfthepool.com/legal, OR http://elite.surfthepool.com/legal, OR http://www.kafko.com/main.php?mod=policies . Limit: One online entry per household. In the event of a dispute, online entries will be deemed to have been submitted by the Authorized Account Holder of the email address submitted at the time of entry. “Authorized Account Holder” means the natural person who is assigned to an email address by an internet access provider, online service provider, or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.
  5. RANDOM DRAWING: Sweepstakes may be presented in different creative presentations by the Sponsor. Eligible entries from all such presentations will be included in the random drawing which will be conducted on or about 5/15/11 under the supervision of the Administrator whose decisions are final.
  6. PRIZE AND ITS APPROXIMATE RETAIL VALUE (ARV): One (1) Grand Prize Winner (“Winner”) will receive products from Latham Pool not to exceed $6,500 (“Products”) and services (“Services”) from their local Latham Pools dealer as selected by Sponsor (“Dealer”) not to exceed $3,500 (“Prize”). Winner will be required to sign a contract as required by the Dealer (“Contract”) before the Dealer can start any work on the Winner’s pool. The Winner will be disqualified and forfeit all rights to the Prize if the Winner does not sign the Contract or if s/he breaches the Contract in any way whatsoever. If the Pool Makeover Products exceed $6,500 and or Services exceed $3,500, Winner will be responsible for any additional costs. Approximate retail value of prize: $10,000. Odds of winning depend upon the number of eligible Entries received; estimated at: 1:50,000.
  7. NOTIFICATION OF WINNERS: Grand Prize Winner (“Winner”) will notified by overnight carrier and will be required to complete and return an Affidavit of Eligibility and Liability and a Publicity Release ("Affidavit") within seven (7) days of date printed on notification or an alternate winner will be selected at random from among all non-winning eligible Entries. If an Affidavit is returned as undeliverable, it will result in disqualification, and the Grand Prize (“Prize”) will be awarded to an alternate winner in a separate random drawing. Acceptance of prize constitutes permission (except where prohibited by law) to use each winner's name, prize won, hometown and likeness for promotional purposes without further compensation. Prizes are not transferable (except to a surviving spouse). All taxes on prizes are Winner’s responsibility.
  1. RELEASES: You assume all liability for any injury, loss or damage caused or claimed to be caused to you or your property by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of any prize, and release Sponsor, its respective affiliates, subsidiaries, directors, employees and agents, and all others associated with the development and execution of this Sweepstakes from any such liability. Entry & acceptance of Prize constitute permission to use the Winner's name, prize won, hometown & likeness for promotional purposes without further compensation, except where prohibited by law. Sponsor is not responsible for any printing, production, typographical, human or other error of any nature in printing of the Sweepstakes notice, Entry or in the administration of the Sweepstakes or announcement of the prizes. Any Sweepstakes notice, Entry, or prize notice containing a printing, production, typographical, human or other error of any nature shall be deemed null and void. No responsibility assumed for lost, late, misdirected, illegible, incomplete, mutilated/postage due or mechanically reproduced Entries, or Entries that have been tampered with or not obtained through legitimate channels, all of which will be disqualified. Liability for an irregular Entry, or sweepstakes notice shall be limited to replacement with another. The Sponsor shall always have the right to take such other measures as it deems necessary or appropriate in its sole discretion to preserve the integrity of the Sweepstakes. In no event shall the Sponsor have any liability or obligation to award more than the prizes offered in conjunction with this Sweepstakes.
  2. ADDITIONAL RULES: Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. No photocopied or mechanically reproduced entries are eligible. Sponsor is not responsible for: (i) lost, late, misdirected, damaged, illegible or postage due mail/entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (ii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the sweepstakes. All random drawings will be conducted under supervision of an independent judging organization. By participating in the Sweepstakes, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor and the independent judging organization, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these official rules may result in disqualification from the Sweepstakes. Sponsor reserves the right to: (i) permanently disqualify from any sweepstakes it sponsors any person it believes has intentionally violated these official rules; and (ii) withdraw the online method of entry if it becomes technically corrupted, (including if a computer virus or system malfunction inalterably impairs its ability to conduct the sweepstakes), & to select Winner from among all entries received.

LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES, IS A VIOLATION OF CRIMINAL & CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
